Terms of Service

Effective date: 10 September 2026 | Version: 2.0

1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of 99ways.io, including its articles, experiments, tools, free accounts, account-only material, forms, and related website features (together, the “Site”).

The Site is operated by Nazari Ecom Solutions, trading as Ninety Nine Ways and using the 99Ways brand (“99Ways”, “we”, “us”, or “our”).

Business details

  • Address: Mr. Treublaan 7, 1097 DP Amsterdam, the Netherlands
  • Dutch Chamber of Commerce (KVK) number: 91552451
  • VAT number: NL004899587B87
  • Contact: privacy[@]99ways.io

These Terms do not govern consulting, implementation, agency, or other client services. Any such work is governed by the proposal, statement of work, services agreement, data processing agreement, or other written terms accepted for that engagement.

99Ways does not currently offer a paid website subscription under these Terms. Any future paid product will be governed by additional terms shown before purchase.

2. When these Terms apply

By using the public Site, you must follow the access, acceptable-use, intellectual-property, and legal rules in these Terms. If you create an account, you enter into an agreement with us for the free account service and confirm that you accept these Terms.

We will make these Terms available before account registration and in a form that can be saved. If you do not accept them, do not create or use an account. Our Privacy & Cookie Policy explains how we process personal data; it is information about data processing and is not made into consent merely by accepting these Terms.

If you use the Site on behalf of an organisation, you confirm that you have authority to act for that organisation. “You” then includes both you and that organisation where the context permits.

3. Eligibility

You must be at least 16 years old to create an account. If the law where you live requires a higher age to enter into this agreement without parental or guardian approval, that higher age applies.

You may not use the Site if applicable law prohibits you from receiving or using it.

4. The free Site

99Ways is a publishing, analytics, and experimentation project. It provides articles, examples, research, demonstrations, and free website or account features. We may use the Site itself to study and demonstrate website measurement, experimentation, conversion analysis, usability, and optimisation, as explained in the Privacy & Cookie Policy.

The Site is provided without a subscription fee. Free access does not create a right to permanent availability, any particular feature, a fixed publication schedule, ongoing support, or preservation of particular content. We may add, change, reorganise, limit, or remove content and free features. We may suspend or discontinue some or all of the Site where reasonably necessary, including for maintenance, security, legal, editorial, or business reasons.

Where a material change affects registered users, we will provide reasonable notice when practicable. You may close your account if you no longer wish to use the changed service.

5. Accounts

You must provide accurate information when creating an account and keep it reasonably current. You are responsible for safeguarding your credentials and for activity carried out through your account, except to the extent that activity results from our own failure to use reasonable care.

You must:

  • use your own account rather than sharing or selling access;
  • choose secure credentials and keep them confidential;
  • notify us promptly if you suspect unauthorised access;
  • avoid creating accounts through deceptive or automated means; and
  • use account-only content in accordance with these Terms.

If Google Sign-In is available, you may authenticate through your Google account. Your use of Google’s service remains subject to Google’s terms. You remain responsible for controlling access to the connected Google account.

You may request account closure using the method in the Privacy & Cookie Policy. Closure ends access to account-only features. Our handling and retention of associated personal data is governed by that policy and applicable law.

6. Ownership of the Site and content

The Site, its design, branding, software, structure, original articles, experiment reports, graphics, databases, and other material created by or for 99Ways are owned by Nazari Ecom Solutions or used under licence. They are protected by copyright, database rights, trademark law, and other applicable rights.

References to third-party products, services, marks, screenshots, or material remain the property of their respective owners. Their appearance on the Site does not imply sponsorship or endorsement unless we expressly say so.

No ownership right is transferred to you by allowing access to the Site or an account.

7. Permission to use our content

Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable permission to:

  • read and use the Site for lawful personal, educational, or internal business purposes;
  • link to a public page in a way that does not misrepresent your relationship with 99Ways; and
  • quote limited extracts where permitted by law, with clear attribution and a link to the source where reasonably possible.

Without our prior written permission, you may not:

  • republish, reproduce, translate, syndicate, or distribute a substantial part of the Site or a systematic collection of extracts;
  • sell, sublicense, package, or commercially exploit our content as your own product or service;
  • create or populate a competing publication, course, database, benchmark, model, or content library from the Site;
  • remove authorship, copyright, source, or rights notices;
  • present our content as your own or imply that we endorse you;
  • bypass access controls, account restrictions, rate limits, or technical protections; or
  • use our names, branding, or visual identity in a way that creates confusion.

Mandatory rights and lawful exceptions, including quotation, criticism, review, and other uses permitted by applicable copyright law, remain unaffected.

8. Automated access, scraping, and text and data mining

Ordinary search engines may crawl public pages in accordance with our published technical instructions, including robots.txt, relevant metadata, and reasonable rate limits. Accessibility tools and security research conducted lawfully and responsibly are not prohibited merely because they are automated.

Except where applicable law gives you a right that cannot be excluded, you may not use bots, crawlers, scrapers, agents, scripts, or similar means to:

  • collect the Site or its data at scale;
  • build or enrich a commercial dataset, search product, content service, or knowledge base;
  • train, fine-tune, ground, evaluate, or improve a generative-AI or machine-learning system;
  • generate substitutes, summaries, or derivative collections that materially replace access to the Site;
  • collect account, visitor, author, or security information;
  • evade rate limits or technical access controls; or
  • impose an unreasonable load on our systems.

To the extent permitted by Article 4 of Directive (EU) 2019/790 and its implementing law, we expressly reserve the rights to reproduce and extract our lawfully accessible works and databases for text and data mining. We may also express that reservation through machine-readable means. A separate written licence may be requested from us.

9. Acceptable use

You must not use the Site to:

  • violate law or another person’s rights;
  • transmit malware, harmful code, spam, or deceptive communications;
  • probe, scan, test, or exploit vulnerabilities without prior authorisation, except where mandatory law protects the activity;
  • disrupt, overload, interfere with, or circumvent the Site or its security;
  • gain unauthorised access to an account, system, or data;
  • impersonate another person or misrepresent an affiliation;
  • harvest personal data or contact information;
  • submit unlawful, threatening, defamatory, infringing, discriminatory, or abusive material;
  • manipulate measurements, experiments, forms, traffic, or account entitlements;
  • use the Site to develop or support unlawful, deceptive, or harmful activity; or
  • help another person do any of the above.

You must comply with reasonable technical instructions and rate limits communicated by the Site.

10. Messages, feedback, and submissions

Contact forms and booking fields are provided for genuine enquiries. Do not submit confidential client data, trade secrets, special-category personal data, malicious code, or content you do not have the right to share.

You retain ownership of original material you submit. You give us a non-exclusive licence to host, copy, transmit, and use the submission as reasonably necessary to respond, provide the requested feature, maintain security, and comply with law.

If you voluntarily provide an idea, suggestion, correction, or general feedback about 99Ways without marking it as confidential, we may use it to improve the Site and our work without payment or an obligation to implement it. This does not give us ownership of your pre-existing intellectual property or confidential information covered by a separate written agreement.

11. Editorial, analytics, and experiment content

99Ways publishes educational material about websites, product analytics, marketing, conversion, experimentation, and related topics. Articles may include opinions, technical examples, reconstructions, data analyses, and reports of experiments.

Results depend on the audience, implementation, measurement method, sample, time period, business model, and surrounding context. A result described on 99Ways may not reproduce on another site. Unless expressly stated, content is not a promise or guarantee of revenue, conversion, retention, ranking, performance, or any other outcome.

Content is general information. It is not legal, financial, tax, medical, security, or other regulated professional advice. You are responsible for evaluating information, checking whether it remains current, testing changes safely, complying with law, and obtaining qualified advice where appropriate.

We aim to make articles useful and accurate, but content may contain errors, incomplete assumptions, or outdated details. Publication dates, source links, methodology, caveats, and later corrections should be considered when assessing a page.

The Site may link to or integrate services operated by others, including analytics, authentication, video, mapping, scheduling, social, and technical platforms. We do not control third-party sites or their independent content, availability, security, terms, or privacy practices.

A link, integration, or reference does not by itself mean that we endorse the provider. Your direct use of a third-party service may be governed by that provider’s terms. Nothing in this section removes responsibilities that applicable law places on 99Ways for its own selection, configuration, or use of a provider.

13. Privacy

Our Privacy & Cookie Policy explains the personal data we collect, why analytics and experiments are central to the Site, the use of IP addresses and interaction data, the standard three-year retention horizon, providers, cookies, and your rights.

Where optional analytics or session recording requires consent, you can use public content without consenting. You may change your choice through the Site’s Privacy choices control.

14. Intellectual-property concerns

If you believe material on the Site infringes your copyright or other rights, email privacy[@]99ways.io with:

  • your name and contact information;
  • the work or right concerned;
  • the exact Site URL and material concerned;
  • the basis of your claim; and
  • any information showing your authority to act for the rights holder.

We may request further information and may remove or restrict material while assessing a credible notice.

15. Suspension and termination

We may restrict, suspend, or close an account, block technical access, or remove a submission where we reasonably believe it is necessary to:

  • address a security threat or service disruption;
  • stop unlawful, abusive, deceptive, or harmful activity;
  • protect 99Ways, users, or third parties;
  • enforce a material breach of these Terms;
  • comply with law or a binding request; or
  • discontinue the relevant free feature.

Where circumstances permit, we will give notice and a reasonable opportunity to address a remediable breach. We may act without prior notice where delay would create risk, where the breach is serious or repeated, or where notice is legally prohibited.

You may stop using the public Site at any time and may close your account. Provisions that by their nature should continue after access ends remain effective, including provisions about intellectual property, prior misuse, disclaimers, liability, disputes, and accrued rights.

16. Availability and warranties

We provide the free Site on an “as available” basis. We do not promise uninterrupted availability, error-free operation, compatibility with every device, preservation of every feature or article, or that content will meet a particular purpose.

We will provide the Site with the level of care required by applicable law. Nothing in these Terms excludes a statutory guarantee or remedy that cannot lawfully be excluded. Any additional warranty is given only if we state it expressly in writing.

17. Liability

Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or remedy that applicable law does not permit us to exclude or limit.

If you use the Site as a consumer

We are responsible for reasonably foreseeable direct loss caused by our failure to comply with these Terms or to use the care required by law. We are not responsible for loss that was not reasonably foreseeable when the agreement was made, for loss caused by your unlawful or unreasonable use, or for business loss arising from consumer use. Your mandatory consumer rights remain unaffected.

If you use the Site for business or professional purposes

To the fullest extent permitted by law:

  • 99Ways is not liable for indirect, incidental, special, punitive, or consequential loss;
  • 99Ways is not liable for lost profit, revenue, opportunity, anticipated saving, goodwill, business interruption, or data, except to the extent the loss cannot lawfully be limited;
  • 99Ways is not responsible for a decision or website change you make based on general Site content; and
  • 99Ways’ aggregate liability arising from or connected with the free Site during any twelve-month period is limited to EUR 100.

The business limitation reflects that the Site is provided free of charge and that professional users can independently verify information, maintain backups, test changes, and obtain advice. Liability for a separately contracted client engagement is governed by that engagement’s written agreement.

18. Responsibility for business misuse

If you use the Site for business purposes, you are responsible for direct losses, liabilities, and reasonable external costs incurred by 99Ways as a result of your deliberate material breach of Sections 7, 8, or 9 or your infringement of a third party’s intellectual-property rights through material you submit. This responsibility does not apply to the extent the loss was caused by 99Ways or could reasonably have been avoided by us.

This section does not impose a general indemnity on consumers.

19. Changes to these Terms

We may update these Terms to reflect changes to the free Site, security needs, legal requirements, or our operating model. A new version applies prospectively from its effective date.

For public use, the current version posted on the Site applies to future access. For registered accounts, we will provide reasonable advance notice of a material change by email, account notice, or another suitable method. If a material change significantly disadvantages an account user, the user may close the free account before the change takes effect. We will request renewed acceptance where required by law or where the nature of the change makes it appropriate.

We will identify the effective date and make prior account-governing versions available on request.

20. Governing law and disputes

These Terms are governed by Dutch law.

If you are a consumer, this choice does not deprive you of mandatory protection available under the law of the country where you habitually reside, and you may use any court or dispute route available to you under mandatory law.

If you use the Site for business purposes, the courts of Amsterdam, the Netherlands, have exclusive jurisdiction over disputes arising from or connected with these Terms, unless mandatory law requires otherwise.

Before starting formal proceedings, please contact us and describe the issue so the parties can try to resolve it.

21. General provisions

If a court or competent authority finds part of these Terms invalid or unenforceable, the remaining provisions continue to apply. A failure or delay in enforcing a right is not a waiver of that right.

You may not transfer an account or your rights under these Terms without our prior written permission. We may transfer our rights and obligations as part of a genuine reorganisation, merger, financing, sale, or transfer of the Site or business, provided that the transfer does not reduce mandatory rights.

These Terms, together with the documents expressly incorporated into them, form the agreement governing the free account and Site use. A separately signed client agreement controls if it expressly conflicts with these Terms for that client engagement.

22. Contact

Questions, complaints, and legal notices about the Site or these Terms may be sent to:
